Service Terms
1. Scope of Application
These Terms of Service apply to individually commissioned technical and analytical services provided by PRO6SELLER.
These may include in particular:
- IT services,
- server and network configuration,
- security configuration,
- privacy and hardening services,
- technical consulting,
- OSINT research,
- digital data analysis,
- digital forensics,
- remote services,
- individual technical support.
2. Individual Service Agreement
Before commencement of an individually agreed service, the following points are determined where possible:
- scope of service,
- objective of the service,
- required data,
- required access,
- estimated time required,
- remuneration,
- processing time, where applicable,
- special technical requirements.
Only the expressly agreed services are owed.
3. Authorization of the Client
The client warrants that it is authorized to have the systems, devices, data, accounts and information it provides examined or processed.
PRO6SELLER may request suitable evidence if there are doubts as to authorization.
4. OSINT
OSINT services are limited to the agreed and legally permissible scope of research.
No unauthorized access to protected systems, accounts or non-publicly accessible data is carried out.
Finding publicly accessible information does not constitute a guarantee of its accuracy or completeness.
5. Digital Forensics
For forensic services, data may be analyzed, reconstructed or technically evaluated.
Successful recovery of deleted, damaged or encrypted data cannot be guaranteed.
For physically damaged storage media, there is a risk of further data loss.
The client is informed of identifiable significant risks prior to performance, where possible.
6. Remote Services
Remote services take place only by prior agreement and with the required authorization.
Access is limited to the agreed scope.
The customer should change or deactivate provided access credentials after completion of the work.
7. Technical Security Services
For security and hardening services, the respective agreed technical scope is owed.
Absolute security of a system cannot be technically guaranteed.
In particular, no guarantee can be given that a system will never be compromised, monitored or attacked in the future.
8. Data Protection for Provided Data
If personal data is provided by the client, the client must be authorized to do so.
Insofar as personal data is processed on behalf of the client and the statutory requirements are met, a data processing agreement pursuant to Art. 28 GDPR may additionally be required.
9. Access Credentials
PRO6SELLER requests access credentials only insofar as these are necessary for the specifically agreed service.
Access credentials should, where possible, be time-limited or changed after completion of the work.
10. Liability of the Client
The client bears responsibility for ensuring that the commissioned intervention, analysis or examination is lawful.
11. No Unlawful Services
Services whose purpose or performance is directed at an unlawful act are not offered or carried out.
In particular, no orders are accepted for unauthorized surveillance, account takeover, circumvention of access protection, identity misuse or comparable unlawful acts.
12. External Services
Insofar as a service is dependent on external APIs or technical providers, the service may be affected by their availability and technical characteristics.
13. Result Reports
Insofar as a report forms part of the agreed service, it describes the technical examinations carried out within the agreed scope and the results identified.
A technical report does not constitute legal advice, unless such advice is expressly agreed and provided in a legally permissible manner.
14. Deletion
Working copies, provided files and other temporarily required data are deleted after completion of the service, unless a statutory retention obligation or express agreement precludes this.
15. Remuneration
Remuneration is based on the individually agreed price or the respective product description.
Additional services generally require prior agreement.
16. Termination
PRO6SELLER may terminate a service if it becomes apparent during performance that the service would be unlawful or that the required authorization does not exist.
Statutory claims remain unaffected.
