Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal in the case of distance contracts.
The withdrawal period is generally 14 days, unless a statutory exception applies.
The withdrawal period begins in accordance with statutory provisions, depending on the type of the respective contract.
Exercising the Right of Withdrawal
To exercise the right of withdrawal, the consumer must inform PRO6SELLER of their decision to withdraw from the contract by means of a clear statement.
The statement may be made in particular by email or via the specified support channel.
Consequences of Withdrawal
If the consumer effectively withdraws from a contract, the statutory consequences of withdrawal are implemented.
For payments, the statutory provisions on reimbursement apply.
For services, services already rendered may, under the statutory requirements, give rise to a pro rata payment obligation.
Early Expiry for Services
For services, the right of withdrawal may expire under the statutory requirements once the service has been fully performed.
This requires in particular that the consumer has expressly requested that performance begin before expiry of the withdrawal period, and that the further statutory requirements are met.
Compensation for Value upon Withdrawal during Performance
If the consumer expressly requests that performance of a service begin before expiry of the withdrawal period, and withdraws from the contract before the service has been fully performed, PRO6SELLER may demand compensation for value for the service already rendered up to the time of withdrawal.
Services on Hardware Provided by the Customer
For certain services, PRO6SELLER works on a device provided or procured by the customer themselves, for example as part of a setup, configuration, or modification. PRO6SELLER does not sell this device.
Before starting the work, the customer is expressly asked whether performance should begin before expiry of the withdrawal period, and is informed that they lose their right of withdrawal once the service has been fully performed. Without this express consent, PRO6SELLER does not begin performance before expiry of the withdrawal period.
Digital Content
For digital content not supplied on a physical data carrier, the right of withdrawal may expire prematurely under the statutory requirements.
